1. Acceptance
By creating a Arci account or using the platform, you agree to these Terms of Service (“Terms”). If you are using Arci on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. If you do not agree, do not use Arci.
2. Service description
Arci (“Arci”), a product of Artha operated by Flare Technologies, is an AI-native marketing platform that connects to your website and third-party marketing channels to provide analytics, content generation, automation, and strategic recommendations. The service is provided on an “as-is” basis and is subject to change with reasonable notice.
3. Accounts
- You must be at least 16 years old to create an account.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately at security@flares.in if you suspect unauthorised access.
- One account per person; do not share credentials.
4. Acceptable use
You may not use Arci to:
- Send unsolicited bulk communications (spam).
- Generate, distribute, or promote content that is illegal, defamatory, harassing, or hateful.
- Circumvent, disable, or interfere with security controls or rate limits.
- Scrape, copy, or resell the Arci platform or API without written permission.
- Impersonate another person or entity.
- Violate any applicable local, national, or international law or regulation.
We reserve the right to suspend or terminate accounts that violate these rules.
5. Connected third-party services
Arci may connect to third-party services (Google Analytics, Google Search Console, social platforms, etc.) on your behalf using OAuth tokens you grant. By connecting a service, you represent that you have the right to grant Arci access to that account. You can revoke access at any time from Settings → Connectors.
Arci’s use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
6. AI-generated content
Arci uses large language models to generate content suggestions. AI outputs may be inaccurate, incomplete, or unsuitable for your use case. You are solely responsible for reviewing and approving any content before publishing. We are not liable for consequences arising from AI-generated content you publish.
We do not train AI models on your workspace data or connected Google data.
7. Intellectual property
You retain ownership of content you create or upload. By using Arci you grant us a limited, non-exclusive licence to store and process your content solely to provide the service. AI-generated outputs produced at your direction are yours to use, subject to the terms of the underlying model provider.
The Arci platform, name, logo, and all related IP are owned by Flare Technologies. Nothing in these Terms transfers ownership of Arci IP to you.
8. Payment and billing
- Free accounts are available with limited features. No card required to start.
- Paid plans are billed monthly or annually in advance.
- Prices are displayed in USD. Indian customers are billed in INR via Razorpay.
- We will give 30 days’ notice before raising prices on existing subscribers.
- Refunds are governed by our Refund Policy.
9. Termination
You may cancel your account at any time from Settings → Account. We may suspend or terminate accounts that violate these Terms, with or without notice for material violations. Upon termination, your data is handled per our Privacy Policy.
10. Disclaimers
Arci is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that results obtained through Arci will be accurate or reliable.
11. Limitation of liability
To the maximum extent permitted by law, Arci’s total aggregate liability to you for any claims arising from these Terms or the service is limited to the fees you paid in the three (3) months prior to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
12. Governing law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, India, except where local consumer protection law requires otherwise.
13. Changes to these Terms
We may update these Terms from time to time. We will notify you by email or in-app banner at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
